These terms and conditions ('Terms') apply to the Experienced service ("Service"). Please read them carefully, as they contain important information about the Service, the rules for using it, and the limitation of our legal liability. You can print off these Terms or store them for future reference. If you do not agree to these Terms, you must not use the Service.
1. ABOUT US
We are Grandworker Ltd, registered in England and Wales with company number 12416168. Our registered office is 107 Cheapside, London, UK.
2. ABOUT THE SERVICE
The Service is a professional matching platform that connects experienced professionals with new and growing companies. The Service helps experienced professionals find suitable opportunities and assists companies in finding experienced talent.
You must be over 18 to use the Service. You may use the Service for both personal and professional purposes.
The Service is based in the United Kingdom. If you are resident outside the UK, it is your responsibility to ensure that you comply with all applicable local laws when using the Service.
If we become aware that you are using the Service otherwise than as permitted by these Terms, we may terminate your use of it.
3. REGISTRATION
You must register to use the Service. As part of the registration process, we ask you to provide certain information about yourself that is true, accurate, and up to date. Should any of your registration information change, please go to Edit Profile and make the necessary changes.
We will never sell your information to others or use it for advertising. For further details of the information we collect, how we use it, and the basis on which we do so, please see our Privacy Policy.
4. SERVICE PLANS
The Service offers different pricing with varying levels of access and features. Details of current plans and pricing can be found on our Pricing page at experiencedcareers.com/pricing.
We may from time to time offer a free trial of the Service for a limited period ("Free Trial"), but this is at our discretion. If we do so, we may at any time, and without giving notice, modify the terms and conditions that apply to the Free Trial, or cancel it.
5. BILLING
A valid payment method, including credit card, is required to process the payment for any services you order. You shall provide Experienced with accurate and complete billing information including full name, street address, city, postal code, telephone number, and valid payment method information.
If billing fails to occur for any reason, we may attempt to charge your credit or debit card one or more times. Should payment continue to fail, we may terminate your order.
We may increase the Charges at any time.
6. CANCELLATION & REFUNDS
When you register for the Service, we will ask you to confirm your acceptance of these Terms and to pay any Charges that apply. No contract exists between you and us until we send you confirmation to the email address you have given, and we have received any applicable Charges.
7. PASSWORD SECURITY
On registration you will have to select a username and password. You must keep your password secure and must not disclose it to or share it with anyone. Your username must also comply with our rules on unacceptable content (see section 10 below).
You will be responsible for all activities under your password. If you know or suspect that someone else has your password, you should change it immediately in "Settings", or if this is not possible contact us at help@experienced.careers.
We reserve the right to change your password if we believe that it is no longer secure.
8. CONTENT
The Service allows professionals to create and manage profiles, and allows Companies to provide details of roles they are looking to fill ("Content").
By posting Content through the Service, you confirm that:
(a) you are the author of the Content and it is your original work, or you have the right to use it
(b) you have the right to grant us and other users of the Service the rights provided in these Terms
(c) posting your Content does not violate anyone else's rights
(d) the Content is not in breach of our rules on Unacceptable Content (section 10)
You retain all your rights in any Content you submit, but grant us the right to display and use that Content as part of providing the Service.
9. UNACCEPTABLE CONTENT
You must not post any Content which may reasonably be regarded as offensive, unlawful, threatening, abusive, harassing, defamatory, obscene, sexually explicit, or racially, ethnically or otherwise objectionable. This rule also applies to usernames. You must not post any Content that contains a virus or other malicious code.
10. INTELLECTUAL PROPERTY RIGHTS
The Service and the content of the Experienced website are protected by intellectual property rights including copyright and trade marks. We reserve all our rights in such intellectual property.
11. AVAILABILITY OF THE SERVICE
While we try to ensure that the Service is normally available 24 hours a day, we cannot be held responsible if for any reason the Service is unavailable at any time or for any period by reason of circumstances beyond our reasonable control.
12. LINKS TO THIRD PARTIES' WEBSITES
The Service may provide links to other websites. Selecting any of these links will direct you to a website that is not related in any way to us. We take no responsibility for the content contained on any such website, and the link to these other websites does not imply an endorsement or recommendation of the website, its products or services.
Before supplying any personal information to any other website, we recommend that you check that website's Privacy Policy. We do not accept responsibility for the protection of any data supplied to other websites.
13. OUR LIABILITY
We will provide the Services using reasonable care and skill. This does not affect your legal rights as a consumer if we fail to do so. We will not be liable to you for any delay in providing the Service, or any failure to provide the Service, or for loss or corruption of data held on your computer or other device or on our servers, if this is due to circumstances beyond our reasonable control.
We will not under any circumstances be liable for any unforeseeable losses, or any business losses, including loss of profit, resulting from your use of, or your inability to use, the Service.
Nothing in these Terms affects any legal liability we may have and which we cannot lawfully exclude or restrict, including liability for:
(a) death or personal injury caused by our negligence; or
(b) our fraud.
14. TERMINATION
We may give you notice to terminate your use of the Service with immediate effect if:
(a) you breach any of these Terms
(b) we have reason to believe that you are using the Service in an unauthorised, unlawful, illegal or fraudulent manner
(c) we are prevented from providing the Service by reasons beyond our reasonable control
(d) you fail to pay any Charges due to us
If you wish to terminate your use of the Service, you may request us to delete your account at any time from within our account management page. Once we receive your request to delete your account, your profile and content will become inaccessible immediately. After 30 days, your data will be deleted from our servers and can no longer be recovered.
On termination for any reason (unless you have the right to terminate), no refund of any Charges that have already become due and have been paid will be made.
15. OTHER IMPORTANT TERMS
We reserve the right to change any of these Terms from time to time without giving notice. Any change will become effective immediately when posted to the Service. If you continue to use the Service, we will take it that you accept any such change.
We may transfer our rights or sub-contract our duties under the contract we have with you, either for operational reasons or in connection with a business sale or reorganisation. Otherwise, the contract is not transferable by either you or us, and nothing in the contract gives any person other than you and us any rights under the contract.
These Terms are governed by the law of England and Wales. Any disputes may be brought before the courts of England and Wales, but that does not affect any rights you may have as a consumer under the law of any other part of the United Kingdom where you live, or any right you may have to take legal proceedings there.
